TERMS AND CONDITIONS
Flightscanner.nl
Version August 2026 — English translation; in the event of any discrepancy, the Dutch version prevails.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Flightscanner.nl: the website and online booking platform www.flightscanner.nl, hereinafter also: “we” or “us”.
Customer: any natural person or legal entity who books or wishes to book a Travel Service via Flightscanner.nl.
Travel Service: a service that can be booked separately via Flightscanner.nl: a flight ticket, a hotel booking or a car rental.
Service Provider: the airline, hotel operator or car rental company that actually performs the Travel Service.
Booking:
the agreement concluded via Flightscanner.nl relating to a Travel Service.
Article 2 – Identity of the trader
Flightscanner.nl is operated by:

Article 3 – Applicability
- These terms and conditions apply to any use of Flightscanner.nl and to every Booking concluded via Flightscanner.nl.
- In addition to these terms and conditions, the (carriage) conditions and fare conditions of the relevant Service Provider apply to every Travel Service. These conditions are made available prior to the Booking or can be obtained from the Service Provider. In the event of any conflict, the Service Provider’s conditions prevail with regard to the performance of the Travel Service.
- Deviations from these terms and conditions are only valid if expressly accepted in writing by Flightscanner.nl.
- If one or more provisions of these terms and conditions are void or annulled, the remaining provisions shall remain in full force. The void or annulled provision shall be replaced by a provision that approximates its purpose and intent as closely as possible.

These terms and conditions have been drawn up in the Dutch language. Translations, including this English version, are provided for convenience only. In the event of any difference in interpretation or content between the Dutch text and a translation, only the Dutch version shall be binding.
Article 4 – Role of Flightscanner.nl: intermediary
- Flightscanner.nl acts exclusively as an intermediary (reseller) between the Customer and the Service Provider. The agreement for the actual performance of the Travel Service (such as the contract of carriage, the accommodation agreement or the rental agreement) is concluded between the Customer and the relevant Service Provider.
- Flightscanner.nl is not itself an airline, hotel operator or car rental company and does not perform the Travel Services itself. The Service Provider is responsible for the correct performance of the Travel Service.
- Flightscanner.nl shall use reasonable efforts to process the Booking carefully and correctly, to transmit it to the Service Provider, and to properly inform the Customer about the Booking.
- Information on Flightscanner.nl regarding Travel Services (including prices, availability, schedules, facilities and classifications) originates from the Service Providers or from third parties. Flightscanner.nl exercises due care in displaying this information but cannot guarantee that it is complete, up to date and accurate at all times. Obvious errors and mistakes, including manifestly incorrect prices, are not binding on Flightscanner.nl.
Article 5 – Stand-alone travel services; no package travel
- Only stand-alone Travel Services are offered via Flightscanner.nl. Each flight ticket, each hotel booking and each car rental is booked separately and constitutes a separate agreement with the relevant Service Provider. Flightscanner.nl does not offer package travel within the meaning of Article 7:500 of the Dutch Civil Code.
- When booking stand-alone Travel Services, the Customer therefore does not benefit from the rights that apply exclusively to package travel under Title 7A of Book 7 of the Dutch Civil Code (Directive (EU) 2015/2302), including protection in the event of the organiser’s insolvency.
- If, shortly after a Booking, the Customer books an additional Travel Service in a manner facilitated via Flightscanner.nl and this results in a linked travel arrangement within the meaning of Article 7:500 of the Dutch Civil Code, the Customer will be informed thereof by means of the statutory standard information form. In that case too, each Service Provider remains solely responsible for the correct performance of its own Travel Service.
Article 6 – Conclusion of the Booking
- A Booking is concluded when the Customer has fully completed the booking process on Flightscanner.nl, has accepted the applicable conditions, and Flightscanner.nl has confirmed the Booking by e-mail.
- The Customer warrants that all details provided with the Booking (including names exactly as stated in the passport or identity document, dates of birth, travel dates and contact details) are complete and correct. The consequences of providing incorrect or incomplete details, including additional costs for name changes or denial of carriage, are for the Customer’s account and risk.
- The Customer must check the booking confirmation and travel documents for accuracy immediately upon receipt and report any inaccuracies to Flightscanner.nl without delay, and in any event within 24 hours.
- A person making a Booking on behalf of other travellers is jointly and severally liable for all obligations arising from the Booking and warrants that he or she is authorised to act on behalf of the co-travellers and that the co-travellers agree to the applicable conditions.
- The Customer declares to be at least 18 years of age and to have legal capacity.
Article 7 – Prices and payment
- All prices on Flightscanner.nl are displayed inclusive of the taxes and surcharges known at the time of publication, unless stated otherwise. Avoidable costs (such as baggage fees or seat reservations) and any service or booking fees charged by Flightscanner.nl are shown separately during the booking process before the Booking is completed.
- Service Providers’ fares, in particular airfares, are dynamic and may change up to the moment the Booking is definitively concluded and paid. The fare is only guaranteed after full payment and confirmation, unless the Service Provider’s conditions provide otherwise.
- Payment is made through the secure payment environment of our payment service provider Stripe, in the manner and within the period indicated in the booking process. In the event of late or incomplete payment, Flightscanner.nl is entitled to cancel the Booking; any resulting (cancellation) costs charged by the Service Provider shall be borne by the Customer.

Some Service Providers charge additional costs locally (such as tourist tax, resort fees, deposits, fuel and insurance costs for car rental, or young driver fees). Where known, these costs are stated in the booking process, but they are paid by the Customer directly to the Service Provider and do not form part of the price paid via Flightscanner.nl.
Article 8 – No right of withdrawal (cooling-off period)
- The Customer is expressly advised that the statutory right of withdrawal for distance contracts does not apply to Travel Services booked via Flightscanner.nl. Pursuant to Article 6:230p under e and g of the Dutch Civil Code (implementing Directive 2011/83/EU), the right of withdrawal is excluded for, among other things, passenger transport, accommodation and car rental where the contract provides for a specific date or period of performance.
- Every Booking is therefore immediately final and binding. Cancellation or amendment is only possible to the extent permitted by the conditions of the relevant Service Provider or by mandatory law, and subject to the applicable charges.
Article 9 – Changes and cancellations by the Customer
- Whether and at what cost a Booking can be changed or cancelled is determined by the fare and cancellation conditions of the relevant Service Provider. Many airfares are non-changeable and non-refundable.
- In addition to any costs charged by the Service Provider, Flightscanner.nl is entitled to charge reasonable administration fees for processing a change or cancellation, as stated on the website or in the booking process.
- Refunds by Service Providers will be passed on to the Customer as soon as and to the extent that Flightscanner.nl has actually received them from the Service Provider, after deduction of agreed charges.
- Failure to use (part of) a Travel Service (“no-show”) does not entitle the Customer to a refund, except to the extent that the Service Provider’s conditions or mandatory law provide otherwise. In the case of flight tickets, in the event of a no-show the Customer may claim a refund of airport taxes and charges not owed, in accordance with the airline’s conditions.
Article 10 – Travel documents, visas and health requirements
- The Customer is personally responsible for holding valid travel documents (a passport or identity card with sufficient validity), required visas, (transit) permits, ETAs or travel authorisations, vaccinations and other health and entry requirements of the countries of destination and transit, as well as for meeting the requirements for driving a rental car (including a valid and, where necessary, international driving licence and a credit card in the name of the main driver).
- Flightscanner.nl may provide general information on these matters, but the Customer must verify the current requirements with the competent authorities (such as embassies, consulates and government agencies). No rights may be derived from general information provided by Flightscanner.nl.
- The consequences of failing to meet the requirements referred to in this article, including denial of carriage or entry into a country, are entirely for the Customer’s account and risk.
Article 11 – Specific provisions for flight tickets
- Flight tickets are subject to the conditions of carriage and fare conditions of the operating and/or contracting airline. The identity of the operating airline is disclosed at the time of booking in accordance with Regulation (EC) No 2111/2005; changes will be communicated as soon as possible.
- Flight times, routes and aircraft may be changed by the airline. Flightscanner.nl will pass on schedule changes and cancellations known to it to the Customer as soon as possible via the contact details provided with the Booking. The Customer must regularly check e-mail (including the spam folder) and telephone before and during the trip and must personally (re)confirm the flight times shortly before departure.
- In the event of cancellation, long delay or denied boarding, the Customer may have claims against the airline under Regulation (EC) No 261/2004 (compensation, care and/or reimbursement). Such claims must be addressed to the operating airline; Flightscanner.nl, acting as intermediary, is not liable in this respect.
- Individual flight segments must be used in the booked order. Failure to use a segment may, under the airline’s conditions, result in the cancellation of subsequent segments.
- Where the Customer combines separate tickets (for example two one-way tickets or connections with different airlines), there is no connection guarantee unless expressly stated otherwise. The risk of missing a connection on separately booked tickets lies with the Customer.
- Baggage rules (checked baggage, hand baggage and special baggage) differ per airline and per fare; the Customer must check these with the airline before departure.
Article 12 – Specific provisions for hotel bookings
- Hotel bookings are subject to the conditions of the relevant accommodation provider, including the rules on check-in and check-out times, cancellation, no-show, deposits and local taxes.
- Hotel classifications (stars) and facilities are based on local standards and on information from the accommodation provider and may differ from Dutch standards. Photographs and descriptions are indicative.
- Special requests (such as room preferences, late check-in or extra beds) will be passed on to the accommodation provider but cannot be guaranteed.
Article 13 – Specific provisions for car rental
- The rental agreement is concluded between the Customer and the car rental company and is usually signed on site. The rental is subject to the conditions of the car rental company, including requirements regarding minimum age, driving licence, a credit card in the name of the main driver, deposit, excess, insurance, fuel policy, mileage and cross-border use.
- Vehicle categories are indicative; the rental company may provide an equivalent or higher-classified vehicle.
- Costs incurred locally (such as additional insurance, additional drivers, child seats, navigation, tolls, fines, damage and fuel) are for the Customer’s account and are settled directly with the rental company.
Article 14 – Obligations of the Customer
1. The Customer must check in on time and be present in good time for departure, and must comply with the instructions of the Service Provider and with applicable laws and regulations.
2. A Customer who causes such nuisance or disturbance that the performance of a Travel Service cannot reasonably be required of the Service Provider may be excluded from (further) participation. All resulting costs and damage shall be borne by the Customer.
3. The website may not be used for speculative, false or fraudulent bookings, for automated data collection (scraping) or for commercial purposes.
Article 15 – Liability
- Flightscanner.nl is solely responsible for the careful performance of its own intermediary activities. Flightscanner.nl is not liable for the (non-)performance or defective performance of the Travel Service by the Service Provider, nor for acts or omissions of the Service Provider or of third parties.
- Any liability of Flightscanner.nl, on whatever basis, is limited to direct damage and to a maximum of the amount of the service and intermediary fees paid by the Customer to Flightscanner.nl for the relevant Booking.
- Flightscanner.nl shall never be liable for indirect damage, including consequential damage, loss of profit, lost savings, reputational damage or immaterial damage, except to the extent that mandatory law precludes such limitation.
- The limitations contained in this article do not apply in the event of intent or deliberate recklessness on the part of Flightscanner.nl or its managerial staff, nor to the extent that mandatory law precludes limitation.
- The Customer is advised to take out appropriate travel and/or cancellation insurance.
Article 16 – Force majeure
Flightscanner.nl is not obliged to perform any obligation, and is not liable for any damage, if and to the extent that performance is prevented by force majeure. Force majeure includes: natural disasters, extreme weather conditions, epidemics and pandemics, war, terrorism, strikes, airspace closures, government measures, as well as failures in third-party systems (such as Service Providers’ reservation systems) beyond the control of Flightscanner.nl.
Article 17 – Use of the website and intellectual property
- All intellectual property rights relating to Flightscanner.nl, including rights to texts, design, software, databases, logos and trademarks, are vested in Flightscanner.nl. Without prior written consent, any use other than consulting and booking for personal, non-commercial purposes is not permitted.
- Flightscanner.nl strives for good availability of the website but does not guarantee that the website will function at all times without faults or interruptions.
- The website may contain links to third-party websites. Flightscanner.nl is not responsible for the content or privacy policy of those websites.
Article 18 – Privacy
Flightscanner.nl processes the Customer’s personal data in accordance with the General Data Protection Regulation (GDPR). For information on the processing of personal data, please refer to the privacy statement on Flightscanner.nl.
Article 19 – Complaints
- Complaints about the performance of a Travel Service must be reported as soon as possible on site to the relevant Service Provider, so that it has the opportunity to resolve the complaint.
- Complaints about the services of Flightscanner.nl itself may be submitted within two months of arising via klantenservice@flightscanner.nl. Flightscanner.nl aims to provide a substantive response within 30 days.
- The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
Article 20 – Applicable law and competent court
- These terms and conditions and every agreement between the Customer and Flightscanner.nl are governed by Dutch law.
- Disputes shall be submitted to the competent court in ’s-Hertogenbosch, the Netherlands. However, a Customer who is a consumer has the right, within one month after Flightscanner.nl has invoked this clause in writing, to opt for resolution of the dispute by the court having jurisdiction by law.
Article 21 – Amendment of these terms and conditions
Flightscanner.nl may amend these terms and conditions. The version applicable to a Booking is always the version in force at the time the Booking was concluded. The current version can be consulted at any time on Flightscanner.nl.
